§ 1 Seller and contact

  1. The service is operated by Michał Kacprzak, trading as Michał Kacprzak, registered in Poland's Central Register and Information on Economic Activity (CEIDG), tax identification number (NIP) 1231196239, using the Warstwa Lab brand, hereafter the “Seller”.
  2. Business and correspondence address: ul. Dobra 9C, 05-504 Runów, Poland.
  3. Address for complaints and returns to which the Customer is entitled: ul. Dobra 9C, 05-504 Runów, Poland.
  4. Contact: kontakt@warstwalab.pl. Website: warstwalab.pl.

§ 2 Scope and definitions

  1. “Customer” means a person or entity using the Service or entering into a contract with the Seller. A person acting for another entity must be authorised to do so.
  2. “Consumer” means a natural person entering into a legal transaction not directly related to their business or professional activity.
  3. “Business customer with consumer rights” means a natural person entering into a contract directly related to their business, where the contract is not professional in nature for that person, in particular having regard to the activity recorded in CEIDG. They receive the protection provided by applicable legislation, including Article 7aa of the Polish Consumer Rights Act and Article 385⁵ of the Polish Civil Code. Providing a tax number or requesting an invoice does not itself remove that protection.
  4. “Protected Customer” includes both a Consumer and a Business customer with consumer rights. “B2B Customer” means a business customer who is not a Protected Customer in relation to the particular contract.
  5. “Goods” means a physical 3D print, including a prototype or a batch of parts. “Specification” means the agreed characteristics of the Goods, including the file version, dimensions, quantity, material, colour, finish, tolerances and intended use accepted by the Seller.
  6. These terms cover the sale of Goods, including design preparation or adaptation forming part of their manufacture. A separately paid design service or delivery of a digital file as a separate subject of a contract requires additional terms provided before that contract is concluded, taking account of the Customer's applicable rights.
  7. Orders may be placed by persons with the required legal capacity. Where the law requires consent from a legal representative, that consent is necessary to conclude the contract.

§ 3 Electronic services

  1. The Seller provides free information about the offer, an indicative estimate calculator, a parameter and file submission form, and functions for downloading an estimate document and requesting its delivery by email. These functions do not require an account and do not constitute a purchase of Goods.
  2. A device with Internet access and a current browser supporting JavaScript are required. A working email address is needed for correspondence and emailed estimates. Model previews require WebGL. Accepted file formats and upload limits are shown in the form; files may require manual analysis.
  3. A contract for a one-off electronic service is concluded when the relevant function is started after these terms have been made available, and ends when that function is completed. The Customer may stop using it by closing the page and end further handling of the enquiry by contacting the Seller. Closing the page does not withdraw data already submitted, delete saved files or terminate a separately concluded sales contract.
  4. The Customer must provide accurate information and must not submit unlawful content, malware or files infringing others' rights. Disrupting the Service, gaining unauthorised access and sending unsolicited bulk enquiries are prohibited.
  5. The Seller may reject an invalid file or restrict functions to the extent necessary to stop a violation or protect the system. Where possible, the Seller explains the reason and allows the enquiry to be corrected. This does not remove obligations under existing contracts.
  6. If the calculator fails or the Service is unavailable, enquiries may be sent by email. Complaints about electronic services follow § 10. These terms may be saved and printed free of charge.

§ 4 Estimates and conclusion of a contract

  1. Information in the Service, calculator results, enquiry identifiers and automatically generated estimate documents are invitations to agree an order, rather than offers to conclude a contract within the meaning of the Polish Civil Code. Submitting a form, downloading a document or receiving an automatic email does not create a payment obligation or start production.
  2. Before preparing an offer, the Seller checks feasibility and, where necessary, requests missing information or proposes design changes. A new order may be refused for justified technical, legal or safety reasons.
  3. The Seller sends a binding offer by email, clearly identifying it as an offer for acceptance. It includes at least the parties' details, Specification and file version, quantity, scope of work, total price including taxes and agreed charges, delivery method and cost, prepayment terms, production/delivery time or how it is calculated, and the offer's expiry date. For personalised Goods, it also identifies the specific personalisation and the applicable withdrawal information.
  4. Before accepting, the Customer receives these terms and applicable withdrawal information, including the form, in the email or an attachment allowing the unchanged text to be saved. The Customer may check and correct information and clarify questions before ordering.
  5. The contract is concluded when, before the offer expires, the Seller receives the Customer's unambiguous email accepting the entire offer and placing an order with an obligation to pay. Silence, an automatic acknowledgement of an enquiry or merely submitting a new file do not constitute acceptance. A reply changing the terms requires renewed agreement and acceptance.
  6. The Seller promptly confirms the contract on a durable medium, no later than delivery of the Goods. Confirmation includes the accepted terms and these terms of service. It is not an additional condition for conclusion where the offer has already been validly accepted.
  7. Individually agreed terms take precedence where permitted by law. They cannot restrict the Protected Customer's mandatory rights.

§ 5 Price and prepayment

  1. Payments are in PLN unless the offer expressly specifies another currency. A price presented to a Consumer is the total price including applicable taxes. Delivery and other payable charges are stated before the contract is concluded; no unagreed surcharges are added.
  2. An initial estimate may change before a binding offer is made, following analysis of geometry, material use, supports, preparation and quality requirements. After conclusion, changes to the price or scope require both parties' agreement.
  3. Unless another schedule is expressly agreed before conclusion, 100% of the total price must be prepaid by bank transfer to the account and within the time specified in the offer.
  4. Production begins once the required prepayment has been received and the complete Specification approved. The offer explains how these conditions affect delivery. The payment is credited against the price and is not earnest money within the meaning of Article 394 of the Polish Civil Code.
  5. Failure to pay on time does not automatically forfeit previously paid money. The Seller may exercise statutory rights, including setting an appropriate additional payment period with notice of withdrawal if it is not met.

§ 6 Files and design rights

  1. The Customer must hold rights or permission allowing the design to be submitted, technical copies made and ordered Goods manufactured, including permission to use protected marks, designs and works. Where justified doubts arise, the Seller may request clarification of the basis for using the design before accepting the order.
  2. Within the rights they hold, the Customer grants the Seller non-exclusive permission to store and reproduce the file in device memory, analyse and prepare it for printing, and make the agreed number of Goods, solely for the estimate and contract. This includes necessary technical actions by persons performing the order for the Seller who are bound by confidentiality.
  3. The Seller may create machine settings, supports and a production file. Submitted G-code or automatic analysis does not oblige the Seller to run that file directly on a printer. Changes to geometry, material or other agreed characteristics require Customer approval.
  4. Approval of a particular design version means acceptance of its characteristics and those in the Specification. It does not release the Seller from proper performance, identifying obvious risks within the agreed scope, or liability for lack of conformity.
  5. Submitting a file does not transfer economic copyright. The Seller gains no right to publish the design, sell additional copies to other customers or use photographs of a bespoke project in advertising without a separate legal basis or permission from the rights holder.
  6. Where the Seller creates a design, the offer specifies whether source files are included and what rights or licences the Customer receives. Buying the physical print alone does not transfer source files or economic copyright. Such transfer requires separate agreement and the legally required form.
  7. Liability for infringement of third-party rights is determined under applicable law and the circumstances. The Customer does not automatically assume liability for the Seller's own acts or omissions.

§ 7 Specification and safety

  1. Before conclusion, the Customer provides requirements relevant to the intended use, particularly dimensions of mating parts, loads, temperature, water or chemical exposure, and colour and surface requirements. The Seller confirms the accepted requirements in the Specification.
  2. Layered printing can produce visible layers, support marks, seams and properties that vary with print direction. Permitted surface characteristics, dimensional tolerances and colour assessment are agreed in the offer; these terms do not introduce an arbitrary acceptable deviation. A screen rendering is not a colour sample unless otherwise agreed.
  3. The Seller is responsible for conformity with agreed characteristics and legal requirements. Information about the technology, prototype status or acceptance of these terms does not exclude that responsibility. Any departure from objective conformity requirements for a Protected Customer must meet statutory conditions, including clear information about the specific characteristic and its separate, express acceptance no later than conclusion.
  4. Standard checking assesses print feasibility and identifiable manufacturing risks. It does not include specialist structural calculations, laboratory testing or certification unless expressly included in the offer. This does not restrict professional diligence or mandatory safety tests and assessments.
  5. Choosing a material alone does not approve a print for food contact, medical use, use as a toy, personal protective equipment or a safety-critical vehicle, machine or structural component. Such use requires prior express agreement and compliance with relevant legal and technical requirements. The Seller refuses orders that cannot meet them.
  6. The Seller provides required markings, safe-use information and limitations appropriate to the Goods. The Customer must follow them and not use parts outside their agreed purpose. If a hazard is suspected, stop use and contact the Seller.
  7. A B2B Customer integrating a part into their own product or placing it on the market must fulfil the duties assigned to them by law. This does not transfer the Seller's own manufacturer or other product-safety duties. No term excludes liability that cannot legally be excluded, including liability for a dangerous product.

§ 8 Production and delivery

  1. Production and delivery times are agreed in the offer. Selecting “standard” or “fast” in the calculator does not confirm a particular date. Unless another period is agreed with a Protected Customer, Goods are delivered without undue delay and within 30 days of conclusion.
  2. Delivery is to the agreed address or by agreed collection. The destination country, method, cost and time are confirmed before acceptance. Costs of reshipping caused by circumstances attributable to the Customer require an explained basis and agreement and cannot include costs for which the Seller is responsible.
  3. If delay becomes likely, the Seller informs the Customer of the cause and proposed date. Notification alone does not unilaterally amend the contract or remove statutory rights for delay or non-performance.
  4. For a Protected Customer, risk of accidental loss or damage passes when the Goods are handed to them or their nominated third party other than the carrier. The exception for a carrier independently chosen by the Customer without the Seller's influence applies only within legal limits.
  5. Checking the shipment and documenting visible damage is recommended. Absence of a courier report, receipt photographs or original packaging is not in itself grounds for refusing a complaint.

§ 9 Changes and cancellation

  1. Changes to the design, quantity, material or date after conclusion require agreement. The Seller explains their effect on price and timing and starts additional work only after approval.
  2. If the Customer requests termination without a statutory withdrawal right, the parties may agree termination and settlement for work actually completed and justified, irrecoverable costs associated with that order. The Seller provides a settlement and does not automatically forfeit the entire prepayment or apply a fixed cancellation penalty.
  3. This procedure does not restrict statutory withdrawal, termination or other rights, including those arising from lack of conformity or non-performance.
  4. If the Seller cannot fulfil an order, they explain the situation and propose a lawful solution. Substituting Goods or materials requires Customer consent. Settlement and any compensation follow applicable law; material shortages or equipment failure do not automatically exclude liability.

§ 10 Complaints

  1. Complaints may be submitted by email, in writing to the address in § 1, or by another legally permitted method. Contact details, order identification, a description and requested remedy are recommended. Photographs may help but are not an absolute requirement. Correspondence or a transfer confirmation can also prove purchase.
  2. The Seller responds within 14 days of receipt on paper or another durable medium, such as email. This period also applies to Business customers with consumer rights and electronic-service complaints. Failure to respond to a Consumer within the statutory period has the effects specified in Article 7a of the Polish Consumer Rights Act. A request for additional information does not itself extend the period.
  3. For a Protected Customer, the Seller is responsible for lack of conformity existing at delivery and revealed within two years, unless a longer usable lifetime was specified by the Seller. Statutory evidence rules apply, including the presumption of non-conformity at delivery, subject to legal exceptions.
  4. A Protected Customer may request repair or replacement. Changing the chosen remedy or refusing it is possible only in statutory cases, particularly impossibility or excessive cost. Repair or replacement is carried out within a reasonable time, without excessive inconvenience and at the Seller's expense, including required transport, material and labour costs.
  5. A Protected Customer may request a price reduction or withdraw in statutory cases, including refusal or failure to achieve conformity, continued non-conformity after attempted repair or replacement, sufficiently serious non-conformity to justify immediate action, or circumstances showing it will not be remedied within a reasonable time without excessive inconvenience. Withdrawal is not available for insignificant non-conformity; the statutory presumption of significance applies.
  6. Following a price reduction, reimbursement is made promptly and within 14 days of receiving the declaration. Following withdrawal for non-conformity, return is at the Seller's cost and the price is reimbursed promptly and within 14 days of receipt of the Goods or proof of return. The original payment method is normally used unless the Customer agrees to another cost-free method.
  7. Complaints also apply to Goods made to individual specifications. The exception to withdrawal without reason in § 11 does not exclude complaints.
  8. Misuse, modification or wear do not automatically justify rejecting every complaint. Their connection to the reported non-conformity and applicable liability rules is assessed. The Seller is not responsible for a problem caused exclusively by circumstances for which they are not legally liable.
  9. These terms do not establish a separate commercial guarantee. If one is provided, a separate statement specifies its conditions without restricting a Protected Customer's statutory rights. § 12 also applies to B2B Customers.

§ 11 Withdrawal from a distance contract

  1. Under Article 38(1)(3) of the Polish Consumer Rights Act, a Protected Customer has no right to withdraw without giving a reason where the contract concerns non-prefabricated goods made to their specification or clearly personalised needs. This may include parts made to an individual model, dimensions or marking where the statutory conditions are actually met.
  2. Before conclusion, the Seller identifies that the Goods fall within this exception and describes their individual characteristics. Manufacture only after ordering, the description “made-to-order print” or selecting a standard option does not automatically exclude withdrawal. The exception does not depend on a waiver by the Customer and does not remove complaint rights.
  3. Where no statutory exception applies, a Protected Customer may withdraw without reason within 14 days of taking possession, personally or through a nominated third party other than the carrier. For several Goods delivered separately under one contract, the period starts upon possession of the last Goods, batch or part.
  4. An unambiguous statement sent before expiry to the Seller's email or address in § 1 is sufficient. The attached form is optional.
  5. The Seller promptly refunds received payments, including the cost of the cheapest ordinary delivery method offered for the order, within 14 days of receiving the statement. The same payment method is used unless another cost-free method is expressly agreed. The Seller may withhold reimbursement until receiving the Goods or proof of return, whichever occurs first, unless the Seller offered to collect them.
  6. Unless the Seller offered collection, the Customer returns or hands over the Goods promptly and within 14 days of withdrawal to the returns address in § 1; dispatch before expiry is sufficient. The Customer bears direct return costs if informed before conclusion. If the Goods cannot normally be returned by post because of their nature, the Seller provides the cost or a reasonable maximum estimate before conclusion.
  7. The Customer is responsible for diminished value caused by handling beyond what is necessary to establish the Goods' nature, characteristics and functioning, subject to statutory exceptions. Unopened original packaging is not required.
  8. If withdrawal information was not properly provided, statutory extension of the right applies. These terms do not restrict other statutory grounds for withdrawal.

§ 12 Terms exclusively for B2B Customers

  1. This section applies only to B2B Customers as defined in § 2, and not to Consumers or Business customers with consumer rights. In doubt, status is assessed from the actual nature of the contract; the Customer's declaration does not replace statutory criteria.
  2. For B2B Customers, the Seller's statutory warranty liability for defects is excluded to the extent permitted by Article 558 § 1 of the Polish Civil Code. The exclusion is ineffective where the law provides otherwise, particularly where the Seller fraudulently concealed a defect.
  3. Subject to paragraph 4, the Seller's contractual damages liability to a B2B Customer is limited to actual loss normally causally connected to the breach, up to the total gross price of that contract. It excludes lost benefits, including lost resale profit or downtime.
  4. Limits do not apply to intentional or grossly negligent damage, personal injury, dangerous-product liability or other liability whose limitation would breach mandatory law. They do not restrict required repayment following termination or legislation.
  5. Before using a part in their product or process, the B2B Customer performs the agreed and required tests for that application. This does not release the Seller from the accepted Specification or their own legal duties.

§ 13 Personal data and confidentiality

  1. The Seller identified in § 1 controls personal data for enquiries and orders. Processing relies on appropriate legal grounds, including pre-contractual steps, contract performance, tax obligations and establishing, pursuing or defending claims. Acceptance of these terms is not marketing consent.
  2. Detailed information about processing, recipients, retention, rights and analytics tools is provided separately before data collection. These terms do not replace that information or required consent for accessing the user's device.
  3. Customers should not include third parties' personal data in models or descriptions unless necessary for the order and lawful. Confidential design requirements should be stated before submission; additional confidentiality terms may be agreed separately.
  4. The Seller uses non-public designs and order information only as necessary for the enquiry, contract and legal duties, sharing them only with authorised persons to the necessary extent. Acceptance of these terms alone does not authorise publication of a design or bespoke project.

§ 14 Disputes and final provisions

  1. A Consumer may seek help from a municipal or district consumer ombudsman and use out-of-court dispute resolution, particularly through the relevant Trade Inspection authority. Information about procedures and bodies is available at https://polubowne.uokik.gov.pl/.
  2. Out-of-court proceedings follow applicable law and procedure. If a complaint does not resolve a dispute, the Seller supplies the legally required position on such proceedings on paper or a durable medium and identifies the competent body where required. These terms do not give advance consent or refusal for all future disputes.
  3. Contracts are governed by Polish law. This choice does not deprive a Consumer of mandatory protection under the law of their habitual residence where applicable. Court jurisdiction follows legislation; these terms do not require the Consumer to use the court at the Seller's place of business.
  4. Amendments apply to contracts concluded after they take effect. Earlier contracts retain the version supplied before conclusion unless the parties lawfully agree a change. Changing the website publication does not automatically amend existing contracts.
  5. Applicable legislation governs matters not covered here, including the Polish Civil Code, Consumer Rights Act, Act on Electronic Services and product-safety rules. These terms do not exclude mandatory statutory rights.
